1. Introduction & Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Discord bot “Amanuensis” (also known as “AMI” or “Amanuensis 2”) (“the Bot”), provided by Lehoczki Imre (“Artfacility”, “we”, “us”, “our”).

By adding the Bot to your Discord server, using its commands, or interacting with its features, you agree to be bound by these Terms and our Privacy Policy (available at our privacy policy page). If you do not agree to these Terms, do not use the Bot.

You also agree to comply with Discord’s Terms of Service and Community Guidelines, as the Bot operates within the Discord platform.

2. Description of Service

Amanuensis is a multi-functional Discord bot offering features such as:

  • An economy system (virtual coins, XP, items, profiles).
  • Minigames (e.g., stock market, pigeon game).
  • Basic moderation tools (e.g., reporting system).
  • Optional AI-powered chatting and image processing capabilities (Premium Feature).
  • Other miscellaneous functions.

Features may be added, modified, or removed at our discretion.

3. User Conduct and Responsibilities

You agree to use the Bot responsibly and in compliance with all applicable laws, Discord’s Terms of Service, and the rules of any server where the Bot is present. You are responsible for:

  • Your interactions with the Bot and other users via the Bot.
  • Any content you generate or input using the Bot’s features (e.g., profile slogans, custom names).
  • Securing your Discord account.

4. Prohibited Uses

You agree not to engage in any of the following prohibited activities:

  • Exploiting Bugs: Attempting to exploit any bugs, glitches, or vulnerabilities in the Bot for personal gain or to disrupt the service. Discovery of exploits may result in data adjustments or removal to maintain balance (e.g., removing illicitly gained virtual currency).
  • Abusing Customization: Using customizable features (e.g., profile slogans, currency names, pet names) to input or display offensive, explicit, hateful, harassing, or otherwise inappropriate content, or content that violates Discord’s ToS. Filters may be in place but are not exhaustive.
  • Harassment: Using the Bot to harass, threaten, or abuse other users. Enforcement of anti-harassment rules is primarily the responsibility of server moderators, but misuse of the Bot for such purposes violates these Terms.
  • Spamming: Excessively spamming Bot commands. While cooldowns exist, deliberate attempts to overload the Bot are prohibited. Intentionally spamming the AI features to incur unnecessary costs may result in temporary suspension of AI access for the server.
  • Real Money Trading (RMT): Trading, selling, or buying the Bot’s virtual currency, items, or any other virtual goods for real money or other real-world value.
  • Interference: Attempting to interfere with, disrupt, or harm the Bot’s operation, servers, or network.
  • Illegal Activities: Using the Bot for any illegal purpose or in violation of any local, national, or international law.

5. Premium AI Features

  • Availability: Access to certain AI-powered features requires an active subscription, managed through Discord’s official server subscription/monetization system.
  • Subscription: Subscriptions are typically activated on a per-server basis.
  • Payment Failure: The Bot periodically checks subscription status. If a subscription payment fails or is cancelled, access to premium features will be revoked for that server.
  • Refunds: We do not offer refunds through an official policy. If you encounter issues with your subscription, please contact us directly via email (artfacility.business@gmail.com) or by sending a direct message to the Amanuensis bot (which will be forwarded to support) to discuss the matter.
  • Third-Party Processing: Use of the AI features involves data processing by Google (Gemini/Vertex AI) as outlined in our Privacy Policy. Your use is also subject to Google’s applicable terms and policies.

6. Intellectual Property

Artfacility retains all rights, title, and interest in and to the Amanuensis bot, including its code, name, branding, and features. These Terms do not grant you any rights to use the Amanuensis name or trademarks without our prior written permission. Replication of specific features may be permitted if permission is explicitly requested from Artfacility and appropriate credit is given.

7. Disclaimers

THE BOT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, ARTFACILITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.  

WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED.  

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OR FOR INTERACTIONS BETWEEN USERS FACILITATED BY THE BOT (E.G., IN-GAME ECONOMY ACTIONS LIKE STEALING VIRTUAL CURRENCY).

WE ARE NOT RESPONSIBLE FOR THE OUTPUT GENERATED BY THE AI FEATURES, ESPECIALLY IF PROMPTED WITH SENSITIVE, INAPPROPRIATE, OR EXPLICIT TOPICS BY USERS. THE AI’S RESPONSES MAY BE INACCURATE OR UNEXPECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTFACILITY, ITS OWNER, DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE BOT; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (INCLUDING OTHER USERS) ON OR THROUGH THE BOT; (C) ANY CONTENT OBTAINED FROM THE BOT (INCLUDING AI-GENERATED CONTENT); OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.  

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ARTFACILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.  

THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.  

9. Termination

We reserve the right to suspend or permanently terminate your access to the Bot, or ban a specific user or server from using the Bot, at our sole discretion, without notice or liability, for any reason, including but not limited to:

  • Breaching these Terms or the Privacy Policy.
  • Violating Discord’s Terms of Service or Community Guidelines through actions related to the Bot (e.g., using prohibited content in customizations).
  • Exploiting bugs or attempting to harm the Bot’s integrity, performance, or security.
  • Engaging in prohibited activities, including RMT or severe harassment via the Bot.
  • Intentionally abusing features in a way that causes undue cost or disruption (e.g., AI spamming).
  • Any other conduct we deem harmful to the Bot, its users, or our interests.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Hungary, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.  

11. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website (https://www.artfacility.xyz/terms-of-service/) and updating the “Last Updated” date. Your continued use of the Bot after such changes constitutes your acceptance of the new Terms. You are advised to review these Terms periodically.
